Construction sites if not properly maintained and properly posted with signs can be very dangerous places for the general public who have to navigate through the construction area

 

For example, a premises may be under renovation and the premises or the sidewalk next to the construction area may remain open to the public. This causes the public to have to interact with the construction area. In a recent case I handled a building owner hired a contractor to construct an expansion to his property. During the construction the contractor had posted a sign indicating the path to be taken to enter the building. However, the sign lead the public to the end of a sidewalk that was poorly lit. When my client attempted to enter the property near night fall when normal lighting was very low, she was unable to differentiate that the sidewalk and the adjacent driveway were not the same elevation. When she stepped off the sidewalk she fell. Due to the careless posting of a sign leading the public to a poorly lit area on the premises, a settlement was reached with the contractor for our client’s injuries. 

 

As motorists we frequently encounter constructions sites on the public roadways. Vehicular and pedestrian traffic are frequently permitted to pass through the roadway construction zone. The Florida Dpt of Transportation have published standards for how to maintain these areas, what traffic control devices the contractor needs to place through the construction zone and how frequently the contractor needs to inspect the traffic control devices to be sure that they are in the proper location. If the traffic control devices are improperly placed or have moved, this can lead to motorist confusion causing serious car accidents. The contractor can be held responsible if his neglect in properly maintaining traffic through the construction zone was a substantial contributing factor to the cause of the motor vehicle accident.
